- Planner: a professional user who creates and manages weddings on behalf of couples.
- Couple: a user (couple owner) who manages or views their own wedding.
- Guest: an invitee who accesses a wedding's guest page via an access code to RSVP and submit information.
- User / you: any person who registers for or uses the Platform.
- Content: all data you upload or enter, including guest lists, photos, texts and documents.
2. Operator details
The Platform is operated by [COMPANY NAME], established at [REGISTERED ADDRESS], registered with the Dutch Chamber of Commerce (KvK) under number [KVK NUMBER], VAT number [VAT NUMBER]. Contact: [CONTACT EMAIL].
3. Applicability
These Terms apply to every visit to and use of the Platform and to all agreements between us and you. By creating an account or using the Platform you accept these Terms. Deviations are only valid if agreed in writing.
4. The service
trwn is a software-as-a-service tool for planning and managing weddings, including guest management, RSVP collection, seating, day-of timeline (draaiboek), budgeting, vendor tracking, a public wedding website, document/PDF export and (for planners) time tracking and invoicing. We provide the software “as is”; we are not a party to any agreement between a planner and a couple, or between you and any third-party vendor.
5. Account and registration
- You must be at least 18 years old and provide accurate information.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You must notify us promptly of any unauthorised use of your account.
- We may suspend or terminate accounts that breach these Terms or are used unlawfully.
6. Subscriptions, trial and pricing
- New accounts start with a free trial of [14] days with access to the platform features. When the trial ends without a paid plan, the account becomes read-only until a plan is purchased.
- Paid tiers (e.g. Basis, Premium, Pro) differ in available features and in the maximum number of weddings you may manage at the same time. Archiving a wedding frees a slot.
- Planners pay a recurring subscription (monthly or yearly). The subscription renews automatically for the same period until cancelled.
- Couples pay a one-time fee for their plan.
- All prices are stated in euros and include 21% Dutch VAT unless stated otherwise. We may change prices for future billing periods; changes do not affect the current paid period.
7. Payment
Payments are processed by our payment provider Stripe. Accepted methods include iDEAL and credit/debit card. For recurring planner subscriptions, paying the first invoice with iDEAL creates a SEPA Direct Debit mandate used for renewals. You authorise us (via Stripe) to charge the applicable amounts. If a payment fails, we may suspend access until payment is completed.
8. Right of withdrawal and cancellation
- Where you are a consumer, you have a statutory 14-day right of withdrawal for distance contracts. Because the Platform is digital content/services delivered immediately, you expressly request immediate access and acknowledge that you lose the right of withdrawal once the service has been fully performed / access has started.
- You may cancel a recurring subscription at any time via your account or by contacting us; cancellation takes effect at the end of the current paid period. We do not provide pro-rata refunds for partial periods unless required by law.
9. Acceptable use
You agree not to: use the Platform unlawfully; upload content that is unlawful, infringing or offensive; attempt to gain unauthorised access, disrupt or reverse-engineer the Platform; send spam; or use the Platform to process data of others without a lawful basis.
10. Your content and intellectual property
You retain all rights to your Content. You grant us a limited licence to host, store, process and display your Content solely to provide the Platform. You are responsible for your Content and for having the rights and lawful basis to upload it. All intellectual property in the Platform itself (software, design, trademarks) belongs to us or our licensors.
11. Guest data and privacy
When you upload guest information you are the data controller for that personal data; we act as a data processor and process it only to provide the Platform, in line with our Privacy Statement ([PRIVACY POLICY URL]) and applicable data-protection law (GDPR). You are responsible for informing your guests and having a lawful basis. A data processing agreement is available on request.
12. Availability and maintenance
We aim for high availability but do not guarantee uninterrupted, error-free service. We may perform maintenance and update or change features. We are not liable for downtime caused by third parties (e.g. hosting, payment or mapping providers).
13. Liability
To the maximum extent permitted by law, our total liability arising from the agreement is limited to the amount you paid for the Platform in the 12 months preceding the event giving rise to liability. We are not liable for indirect or consequential damages, lost data, lost profits, or damages resulting from your use of (or inability to use) the Platform. Nothing in these Terms excludes liability that cannot be excluded under Dutch law.
14. Indemnification
You indemnify us against third-party claims arising from your Content or your use of the Platform in breach of these Terms or applicable law.
15. Term and termination
These Terms apply for as long as you use the Platform. We may suspend or terminate your access for material breach. On termination, your right to use the Platform ends; we may delete your data after a reasonable retention period as described in our Privacy Statement.
16. Changes to these Terms
We may amend these Terms. We will publish the updated version on this page with a new “last updated” date and, where the change is material, notify you. Continued use after the effective date constitutes acceptance.
17. Governing law and disputes
These Terms are governed by Dutch law. Disputes will be submitted to the competent court in the district of [COURT DISTRICT], unless mandatory law provides otherwise.
